Correct information on the application form
You warrant that the information which you provided to us when completing the application form is complete, true, and correct, to the best of your knowledge.
Compliance with guidelines
You agree to comply with Queensland Rail’s
guidelines. Failure to comply with these guidelines will be a breach of this contract and entitle Queensland Rail to damages for any loss incurred.
Safety
Your attendance at, and activities within, Queensland Rail’s property is entirely at your own risk. You must ensure that you, your employees, contractors, and agents comply with all relevant laws and safety regulations, standards and the specific safety requirements set out in the
guidelines.
Please note that Queensland Rail does not permit student film productions to film on our network due to safety considerations.
Equipment
You must ensure all equipment brought onto Queensland Rail property and assets is detailed in the application form and its use complies with the requirements set out in the
guidelines.
Fees
You agree to pay the fees which are set out in your quote in consideration of Queensland Rail giving you permission to film or photograph its people or property.
Queensland Rail representative
Queensland Rail might appoint a representative as the primary contact point for you throughout the process. If Queensland Rail does appoint a representative then that person will assist you in navigating the whole process.
Insurance
You will have, and maintain the insurance required according to the
guidelines.
Intellectual property
Nothing in this Agreement gives you any proprietary or other right in any pre-existing intellectual property of Queensland Rail (including without limitation any branding, logo, or trademark).
Liability
Despite any other provision of this Agreement Queensland Rail’s total aggregate liability to you or third parties for any damage, loss, claims, or actions (including death and personal injury) arising under or in connection with this Agreement, shall be limited to the total fee payable by you under this Agreement.
Release and discharge
You release and discharge Queensland Rail from any actions, suits, proceedings, claims, demands, costs, losses, damages, and expenses which could or might be brought against or made upon it under or in connection with this Agreement.
Privacy
We may collect and use your personal information in accordance with our
Privacy statement.
Termination
Queensland Rail may suspend or terminate this agreement, and your filming activities at any time and for any reason at its absolute discretion. If the agreement is terminated by Queensland Rail the fees payable will be reviewed on a case-by-case basis based on the reason for cancellation and the volume of filming already undertaken.
